Try Kenyan terror suspects here, says team

Kenyans handed over to Uganda on terrorism charges should be returned to face justice at home, the parliamentary Committee on Defence and Foreign Relations says.

The committee says the Government contravened the Constitution by sending Kenyans to Uganda without the due process.

“Renditions, arrest, detention and removal from Kenya were illegal,” the team’s report tabled in Parliament on Tuesday states.

The committee was chaired by Wajir West MP Adan Keynan. Eight Kenyans were taken to Uganda following the July 11, 2010 suicide terrorist attacks in Kampala which killed 76 people and seriously injured 96.

Al-Shabaab claimed responsibility for the attacks. Sixteen Kenyans were arrested and face charges in Ugandan courts.

Kenyan’s Internal Security Minister told the Defence committee of Parliament during the inquiry that the arrest and surrender of the suspects was according to Article 124 of the East African Community Treaty.

Former Attorney-General Amos Wako told the committee that the suspects were handed over to Uganda without reference to his office.

The team, however, states that there is an urgent need to have a comprehensive legislation to address the threat posed by terrorism.

Kenyans who were arrested in Uganda were Mr Hassan Abdu Issac, Mr Hussein Aliwali Abdi, Mr Abdul Aziz Abdi alias Matope, Mr Abdulahi Mohamod Ahmed, Mr Kenyoro Andrew, Mr Osman Mohamed, Mr Khalif Abdi Muhammed, Mr Habib Suleiman Njoroge, Mr Omar Adua Omar and Mr Al-Amin Kimathi alias Joe Kimathi who has since returned to Kenya.

Kenyans arrested in Kenya by Kenyan police and handed over to Ugandan authorities are Mr Idriss Magondu alias Christopher Magondu, Mr Hussein Hassan Agade, Mr Mohammed Hamid Suleiman, Mr Mohammed Adan Abdow and Mr Yahya Suleiman Mbuthia.
