Ky. trial of accused Somali man delayed

Thursday, January 27, 2011

LOUISVILLE, Ky., Jan. 27 (UPI) -- The trial of a Somali man accused of killing his four children in a Louisville, Ky., public housing complex has been delayed because of his health.

A defense lawyer said Said Biyad, scheduled to go to trial Feb. 8 for allegedly cutting his children's throats after raping his wife, is suffering from health problems, The (Louisville) Courier-Journal reported Wednesday.

Attorney Mike Lemke said doctors at the Kentucky Correctional Psychiatric Center, where Biyad was sent recently for testing, found he was suffering from a "fairly serious medical condition."

Facing a probable insanity defense, prosecutors asked that Biyad be evaluated at KCPC.

The evaluation has not been completed as Biyad is undergoing treatment for the undisclosed health issue, Lemke said.

Jefferson Circuit Judge James Shake, who has ruled twice that Biyad is competent to stand trial, set a new trial date of April 18.

In addition to murder charges related to the killing of the children, Biyad is also facing charges of attempted murder, rape and assault on his wife Fatuma Amir, who survived the Oct. 6, 2006, attack.
